Welcome to 3 Minute Man. These Terms of Use (the "Terms") are a binding contract between you and Use All Five, Inc. ("3 Minute Man," "we," and "us"). Your use of the Services in any way means that you agree to all of these Terms, and these Terms will remain in effect while you use the Services. These Terms include the provisions in this document as well as those in our Privacy Policy.
Please read these terms carefully. They cover important information about Services provided to you and any charges, taxes, and fees we bill you. These Terms include information about future changes to these Terms, automatic renewals, limitations of liability, a class action waiver, and resolution of disputes by arbitration instead of in court.
We are constantly trying to improve our Services, so these Terms may need to change along with our Services. We reserve the right to change the Terms at any time, but if we do, we will place a notice on our site located at 3minman.com, send you an email, and/or notify you by some other means.
If you don't agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes.

The Children's Online Privacy Protection Act ("COPPA") requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 16. We do not knowingly collect or solicit personally identifiable information from children under 16; if you are a child under 16, please do not attempt to register for or otherwise use the Services or send us any personal information. If we learn we have collected personal information from a child under 16, we will delete that information as quickly as possible. If you believe that a child under 16 may have provided us personal information, please contact us at hello@3minman.com.
You may be required to sign up for an account and select a password. You promise to provide us with accurate, complete, and updated registration information about yourself. You may not select as your username a name that you don't have the right to use, or another person's name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission.
You represent and warrant that you are of legal age to form a binding contract (or if not, you've received your parent's or guardian's permission to use the Services and have gotten your parent or guardian to agree to these Terms on your behalf). If you're agreeing to these Terms on behalf of an organization or entity, you represent and warrant that you are authorized to agree to these Terms on that organization's or entity's behalf and bind them to these Terms.
You will only use the Services for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. If your use of the Services is prohibited by applicable laws, then you aren't authorized to use the Services. We can't and won't be responsible for your using the Services in a way that breaks the law.
You will not share your account or password with anyone, and you must protect the security of your account and your password. You're responsible for any activity associated with your account.
3 Minute Man is not medical advice, not a medical device, and not a substitute for professional medical care. The exercises, protocols, and wellness content we provide are based on published research but are general fitness information, not personalized medical guidance.
Consult a licensed physician before starting any exercise program, especially if you have a medical condition, injury, or are over 50 years of age. Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any symptoms that concern you.
Individual results vary. We make no guarantees about specific health outcomes, weight loss, metabolic improvements, or any other result. The Services track self-reported metrics (such as energy ratings and break completion) but do not measure medical outcomes and are not designed to diagnose, treat, cure, or prevent any disease.
You assume full responsibility for any risks, injuries, or damages, known or unknown, which you may incur as a result of participating in the exercises and activities suggested by the Services.
Subject to these Terms, 3 Minute Man grants you a non-transferable, non-exclusive, revocable, limited license to use and access the Services solely for your own personal, non-commercial use.

Certain features of our Services require a paid subscription. By subscribing, you agree to pay the subscription fees as presented at signup. Subscriptions renew automatically (monthly or annually, depending on the plan you selected) until you cancel. We bill through Stripe, our third-party payment processor. We do not store your full payment card information; Stripe does.
We offer a limited free trial to new users. During the trial, you have full access to paid features. When your trial ends, if you have not upgraded to a paid plan, your account will automatically transition to our Free tier, which includes limited break access and no progress tracking. You can upgrade at any time from the Services.
You can cancel your paid subscription at any time through the Services settings or directly via the Stripe customer portal. When you cancel, you will retain paid access through the end of your current billing period, after which your account will revert to the Free tier. We do not provide refunds for partial billing periods except as described below.
We offer a 7-day no-questions-asked refund on your first paid purchase. To request a refund, email hello@3minman.com within 7 days of your initial purchase. After the 7-day window, refunds are provided at our sole discretion.
We reserve the right to change pricing at any time. For existing subscribers, we will provide at least 30 days' notice of any price increase before it applies to your renewal.
Excluding any User Submissions that you provide, you acknowledge that all the intellectual property rights, including copyrights, patents, trade marks, and trade secrets, in the Services and its content are owned by 3 Minute Man or 3 Minute Man's suppliers. These Terms and access to the Services do not grant you any rights, title or interest in or to any intellectual property rights, except for the limited access rights expressed in the "Your use of the Services" section.
3 Minute Man, the 3 Minute Man logo, the "3MM" mark, and all related graphics, logos, service marks and trade names used on or in connection with the Services are the trademarks of 3 Minute Man and may not be used without permission in connection with any third-party products or services.
Anything you post, upload, share, store, or otherwise provide through the Services is your "User Submission." Some User Submissions are viewable by other users. For any User Submission, you hereby grant 3 Minute Man a license to translate, modify (for technical purposes, for example making sure your content is viewable on an Android device as well as a computer), reproduce, and otherwise act with respect to such User Submissions to enable us to deliver the Services to you and other users.
If you submit feedback, suggestions, ideas, bug reports, or feature requests to us, you agree we may use this feedback without any obligation to you and without compensation.
Any information or content publicly posted or privately transmitted through the Services is the sole responsibility of the person from whom such content originated, and you access all such information and content at your own risk. We aren't liable for any errors or omissions in that information or content or for any damages or loss you might suffer in connection with it.
The Services may contain links or connections to third-party websites or services that are not owned or controlled by 3 Minute Man, such as Stripe for payments, Supabase for cloud services, and Chrome Web Store for distribution. When you access third-party websites or use third-party services, you accept that there are risks in doing so, and that 3 Minute Man is not responsible for such risks.
We're always trying to improve the Services, so they may change over time. We may suspend or discontinue any part of the Services, or we may introduce new features or impose limits on certain features or restrict access to parts or all of the Services. We'll try to give you notice when we make a material change to the Services that would adversely affect you, but this isn't always practical. Similarly, we reserve the right to remove any content from the Services at any time, for any reason (including, but not limited to, if someone alleges you contributed that content in violation of these Terms), in our sole discretion, and without notice.
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS, AND 3 MINUTE MAN (AND OUR SUPPLIERS) EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ALL WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. WE (AND OUR SUPPLIERS) MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS, OR WILL BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE. IF APPLICABLE LAW REQUIRES ANY WARRANTIES WITH RESPECT TO THE SERVICES, ALL SUCH WARRANTIES ARE LIMITED IN DURATION TO NINETY (90) DAYS FROM THE DATE OF FIRST USE.
TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE) SHALL 3 MINUTE MAN (OR OUR SUPPLIERS) BE LIABLE TO YOU OR TO ANY OTHER PERSON FOR (A) ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING DAMAGES FOR LOST PROFITS, LOSS OF GOODWILL, WORK STOPPAGE, ACCURACY OF RESULTS, OR COMPUTER FAILURE OR MALFUNCTION, OR (B) ANY AMOUNT, IN THE AGGREGATE, IN EXCESS OF THE GREATER OF (I) $100 OR (II) THE AMOUNTS PAID AND/OR PAYABLE BY YOU TO 3 MINUTE MAN IN CONNECTION WITH THE SERVICES IN THE TWELVE (12) MONTH PERIOD PRECEDING THIS APPLICABLE CLAIM, OR (C) ANY MATTER BEYOND OUR REASONABLE CONTROL.
You agree to indemnify, defend and hold harmless 3 Minute Man and its officers, directors, employees, agents, affiliates, successors and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys' fees, arising from or relating to your use or misuse of the Services or your breach of these Terms.
You're free to do that at any time by uninstalling the extension and/or deleting your account; please refer to our Privacy Policy, as well as the licenses above, to understand how we treat information you provide to us after you have stopped using our Services.
3 Minute Man is also free to terminate (or suspend access to) your use of the Services or your account for any reason in our discretion, including your breach of these Terms. 3 Minute Man has the sole right to decide whether you are in violation of any of the restrictions set forth in these Terms.
We want to address your concerns without needing a formal legal case. Before filing a claim against 3 Minute Man, you agree to try to resolve the dispute informally by contacting hello@3minman.com. We'll try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 15 days of submission, you or 3 Minute Man may bring a formal proceeding.
We both agree to arbitrate. You and 3 Minute Man agree to resolve any disputes arising out of these Terms or the Services through final and binding arbitration by a single arbitrator, except as set forth under "Exceptions to Agreement to Arbitrate" below.
Exceptions to Agreement to Arbitrate. Either you or 3 Minute Man may assert claims, if they qualify, in small claims court in San Francisco, California or any United States county where you live or work. Either party may bring a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Services, or intellectual property infringement (for example, trademark, trade secret, copyright, or patent rights) without first engaging in arbitration or the informal dispute-resolution process described above.
NO CLASS ACTIONS. You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren't allowed.
You will be responsible for paying, withholding, filing, and reporting all taxes, duties, and other governmental assessments associated with your activity in connection with the Services.
The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms. These Terms, and the relationship between you and 3 Minute Man, will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any claim or controversy arising out of or relating to the use of the Services, these Terms, or any other acts or omissions for which you may contend that 3 Minute Man is liable, shall be finally, and exclusively, settled by arbitration as set forth above.
You may not assign, delegate, or transfer these Terms or your rights or obligations hereunder, or your Services account, in any way (by operation of law or otherwise) without 3 Minute Man's prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without consent.
No agency, partnership, joint venture, or employment is created as a result of these Terms and you do not have any authority of any kind to bind 3 Minute Man in any respect whatsoever.
In any action or proceeding to enforce rights under these Terms, the prevailing party will be entitled to recover costs and attorneys' fees.
